The Seller undertakes that machinery to be delivered to the Buyer shall be 100% brand-new, and in good conditions under normal use, care and maintenance. The Seller shall repair any malfunction or to replace any defective parts for free of charge, providing that such malfunction or defective part is not caused by negligence on the part of the Buyer except the easy broken part (heating tube, cutting knife). Under no circumstances shall the Seller will responsible for any losses and damages by the seller beyond the above-mentioned warranty.
The Seller shall not be responsible for any delay or failure in shipping all or any part of Commodities caused by prohibition of export, refusal to issue export license or permit, arrests and restraint of rulers, government and people, war or warlike operation, blockade, commotions, riots, act of God, plague or other epidemics, destruction of goods by fire or flood, or any other causes beyond Seller’s control.
